But he did reach for the weapon, Tomba said.

“The officers ordered him to stop and to show his hands and he went into his waistband and pulled out the weapon,” he said.

The 12-year-old’s name has not been released by police. He died early Sunday at MetroHealth Medical Center following surgery, according to the hospital and the family’s attorney.

Tomba showed reporters the weapon — a large, black BB– or pellet-type replica gun resembling a semiautomatic pistol. An orange tip indicating the gun was an air gun had been removed, police said.

According to the initial 911 call, provided by CNN affiliate WEWS, the boy was scaring people at the park.

“There’s a guy in there with a pistol, you know, it’s probably fake, but he’s like pointing it at everybody,” the caller said.

“He’s sitting on a swing right now, but he’s pulling it in and out of his pants and pointing it at people,” the caller said. “He’s probably a juvenile, you know?”

People who had gathered around the early-morning media scrum with Tomba hurled angry questions at him, accusing police of unnecessary violence.

“It’s a toy gun and a 12-year-old,” a woman in the crowd yelled as reporters tried to ask questions, according to video provided by WEWS.

While saying a thorough and open investigation was under way, Tomba defended the officers’ actions in what he called a “very, very tragic situation.”

“They were doing their job,” he said.

(Reuters) – An advanced malicious software application has been uncovered that since 2008 was used to spy on private companies, governments, research institutes and individuals in 10 countries, anti virus software maker Symantec Corp said in a report on Sunday.

The Mountain View, California-based maker of Norton anti virus products said its research showed that a “nation state” was likely the developer of the malware called Regin, or Backdoor. Regin, but Symantec did not identify any countries or victims.

Symantec said Regin’s design “makes it highly suited for persistent, long-term surveillance operations against targets,” and was withdrawn in 2011 but resurfaced from 2013 onward.

The malware uses several “stealth” features “and even when its presence is detected, it is very difficult to ascertain what it is doing,” according to Symantec. It said “many components of Regin remain undiscovered and additional functionality and versions may exist.”

Almost half of all infections occurred at addresses of Internet service providers, the report said. It said the targets were customers of the companies rather than the companies themselves. About 28 percent of targets were in telecoms while other victims were in the energy, airline, hospitality and research sectors, Symantec said.

Obama Shrugs Off Criticism on Immigration from House Republicans

WASHINGTON (Reuters) – President Barack Obama shrugged off criticism of his executive action on immigration with a challenge to House of Representatives Republicans: if you don’t like it, do something.

Obama was asked in an interview broadcast on Sunday about House Speaker John Boehner‘s assertion that he was acting like an emperor in using executive powers to tackle the issue of the 11 million immigrants living in America without documents.

“Well, my response is pass a bill,” Obama said in the interview with ABC’s “This Week,” which was taped on Friday. “Congress has a responsibility to deal with these issues and there are some things that I can’t do on my own.”

Obama announced on Thursday he was easing the threat of deportation for millions of undocumented immigrants. His measures include allowing some 4.4 million people who are parents of U.S. citizens and legal permanent residents and who have been in the country for five years to remain in the country temporarily, with the right to work.

In the ABC interview, Obama, who has long said he preferred legislation to unilateral action, cited a bipartisan immigration bill passed by the U.S. Senate last year and urged the House to take it up.

CAIRO – The spokesman for the joint U.N.-African Union peacekeeping force in Darfur says the Sudanese government has asked his mission to prepare plans to exit the country.

The snub comes amid tension between the mission and the government over an investigation into allegations of mass rape in the violence-torn western region of Darfur. Initially, the mission was denied access to Tabit, a North Darfur village where allegations surfaced in media that women were raped by government-allied troops. Following a brief visit, escorted by government troops, the mission said it had not immediately discovered evidence of rape.

Spokesman Ashraf Eissa said Sunday the formal memo to leave was delivered last week. The mission’s mandate expires in March. The U.N. Security council asked the organization’s secretary-general to prepare an exit strategy by February.
